CAPTION:        Concerning psilocybin-related businesses in the City of Myrtle Creek, Oregon   

QUESTION:     Shall psilocybin-related businesses be allowed in the City of Myrtle Creek?

STATEMENT:        State law allows for the manufacture, distribution, and possession of psilocybin and psilocin. State law provides that a city council may adopt an ordinance to be referred to the voters to prohibit the establishment of any of the registered or licensed activities. The City Council of Myrtle Creek passed a resolution referring to the voters of the City of Myrtle Creek the question whether to allow psilocybin-related businesses within the city limits of the City of Myrtle Creek. This ballot measure asks you to answer that question.

A “Yes” vote allows psilocybin-related businesses inside the city limits of the City of Myrtle Creek.

A “No” vote prohibits psilocybin-related businesses inside the city limits of the City of Myrtle Creek.

EXPLANATORY STATEMENT:  

This measure concerns the establishment of psilocybin-related businesses in the City of Myrtle Creek. Psilocybin mushrooms are wild or cultivated mushrooms that contain psilocybin, a naturally occurring psychoactive and hallucinogenic compound.

Measure 109, approved by Oregon voters in November 2020, provides that the Oregon Health Authority shall license and regulate the manufacturing, transportation, delivery, sale and purchase of psilocybin products and the provision of psilocybin services.

Under Measure 109, cities and counties may place referendums on local ballots to prohibit psilocybin-product manufacturers and/or psilocybin service centers within their jurisdictions. The City Council of the City of Myrtle Creek has adopted a resolution referring to the voters the question of the establishment of psilocybin-related businesses in the City of Myrtle Creek.

If the voters of Myrtle Creek vote “yes,” then the establishment of psilocybin-related businesses is approved. If the voters of Myrtle Creek vote “no,” then the establishment of psilocybin-related businesses is prohibited.
